Welcome to the website of Lake Merritt Run Club (“LMRC,” “we,” “our,” or “us”). By accessing lakemerrittrunclub.org, or by registering for our memberships, races, or training programs, you agree to follow these Terms of Use.

1. About Lake Merritt Run Club

Lake Merritt Run Club is a volunteer-driven nonprofit based in Oakland, California. Since 1977, we have provided community runs, training, and races for runners of all abilities. Our website is a tool to help you manage your membership, sign up for events, and stay connected with the East Bay running community.

2. Membership & Accounts

To access the Member Portal, you must create an account. You agree to:

• Provide accurate information (Name, Email, etc.).

• Keep your login details safe.

• Be responsible for all activity that happens under your account.

3. Fees and Automatic Renewals

• Non-Refundable: Membership dues and race entry fees are non-refundable unless stated otherwise by the Board of Directors.

• Renewals: If you are on an automated renewal plan, your payment method will be charged at the end of your term. To avoid being charged, you must cancel your plan at least 24 hours prior to the renewal date via the Member Self-Service Portal or email membership@lakemerrittrunclub.org.

4. Use of the Website

You agree to use this site only for lawful purposes. You may not:

• Scrape or harvest data from the site using automated systems.

• Attempt to gain unauthorized access to other members' data.

• Interfere with the security or operation of the website.

5. Health, Safety, and "Rules of the Road"

Running involves inherent risks. By participating in Lake Merritt Run Club activities, you acknowledge:

• Physical Ability: You are physically fit to participate and have consulted a physician if necessary.

• Assumption of Risk: You assume all responsibility for your safety regarding traffic, weather, and course conditions.

• Conduct: You will follow all instructions from run leaders and pacers.

• Leave No Trace: You agree to respect the roads, parks, and trails where we run throughout the East Bay by not leaving any trash behind.

6. Liability Waiver & Release

To the fullest extent permitted by law, Lake Merritt Run Club and its volunteers and officers are not liable for any injuries or damages resulting from the use of the website or participation in club events. You release Lake Merritt Run Club from all claims of liability arising out of your participation in club activities.

7. Photography and Media

Lake Merritt Run Club often takes photos or videos during runs (like the Fourth Sunday Run & Marathon Training Runs). By participating, you grant Lake Merritt Run Club permission to use your likeness on our website, social media, and newsletters for promotional purposes.

• Opt-Out: If you do not wish to appear in club media, please notify the club membership team at president@lakemerrittrunclub.org .

8. Intellectual Property

All content on this site—including the 1977 legacy branding, logos, graphics, and race results—is the property of Lake Merritt Run Club. You may use this content for personal, non-commercial use only.

9. Third-Party Services

We use third-party tools to help run the club (such as WildApricot Platform including payment methods or Stripe for payments). Lake Merritt Run Club is not responsible for the privacy practices or policies of these external services.

10. Termination of Use

We reserve the right to suspend or terminate access to the website or club membership for users who violate these terms or engage in conduct that is harmful to the club community.

11. Governing Law

These Terms are governed by the laws of the State of California. Any disputes will be resolved in the courts located in Alameda County, California.
